Abstract

This paper examines compliance in cross-border AI projects, with a focus on personal data transfers under Turkish law. As AI technologies advance, the need for robust frameworks to safeguard personal data during international transfers increases. The Turkish Personal Data Protection Act enforces strict rules for transferring personal data outside Turkey, aiming to uphold privacy rights. The paper examines legal tools, including criteria for adequate protection, as well as contractual safeguards such as binding corporate rules and standard contractual clauses. By providing an overview of these legal frameworks, the paper helps organizations understand how to effectively comply with Turkish regulations in cross-border AI efforts, with a focus on standard contractual clauses. The paper emphasizes the importance of proactive compliance in fostering responsible AI development and safeguarding personal data rights.
